The legal odyssey of Misran Toni, a local activist from Muara Kate, East Kalimantan, has reached a critical juncture following his acquittal by the Tanah Grogot District Court, shedding light on systemic issues of judicial integrity and the hazardous intersection of industrial mining and public safety. Misran, known affectionately as Imis, was cleared of all charges related to a fatal assault that claimed the life of an activist named Russel at a coal hauling checkpoint in April 2024. However, despite the court’s ruling that the prosecution failed to provide credible evidence of his involvement, the legal battle has shifted to the Supreme Court as state prosecutors mount an appeal that advocates describe as an attempt to legitimize a flawed investigation.
The case has become a focal point for human rights organizations, including the East Kalimantan Mining Advocacy Network (Jatam Kaltim) and the Samarinda Legal Aid Institute (LBH Samarinda), who argue that Misran was used as a "scapegoat" to provide a quick resolution to a high-profile murder. The acquittal, handed down on April 16, 2026, initially offered a glimmer of hope for the Muara Kate community, which has been locked in a bitter struggle against the use of public roads for coal transportation. Yet, the subsequent discovery of alleged procedural fraud in the notification of the prosecution’s appeal has reignited fears of institutional bias.
A Chronology of Conflict and Alleged Engineering
The roots of the case trace back to November 15, 2024, when a violent attack occurred at a community-led guard post in Muara Kate, Paser Regency. The post had been established by residents to block coal-hauling trucks from using public roads, a practice that has caused numerous fatal accidents and environmental degradation in the region. At approximately 4:00 AM, unidentified assailants attacked the sleeping guards. Russel was killed by a throat wound, while another resident, Anson, sustained severe injuries.
Misran Toni was not present at the post during the attack, having returned home earlier that evening. He only arrived at the scene after being summoned by his son to perform "penawaran," a traditional Dayak healing ritual involving prayers, in a desperate attempt to help the victims. Despite his role as a first responder and the lack of physical evidence linking him to the crime, Misran was named a suspect months later. This development followed a high-profile visit by Vice President Gibran Rakabuming Raka to Muara Kate in June 2025, which put immense pressure on local law enforcement to produce results.
The ensuing investigation was marked by what defense lawyers call "case engineering" (rekayasa kasus). During his detention at the Paser Police Station and later at the East Kalimantan Regional Police (Polda Kaltim), Misran alleges he was subjected to psychological pressure and bribery attempts. He claims officers offered him alcohol and women in exchange for a confession. When he refused, he was forcibly transferred to a psychiatric hospital in Samarinda for an unannounced mental evaluation. Although doctors declared him mentally fit within six days, the police used the hospitalization as a pretext to extend his detention, leading to a violent confrontation on November 12, 2025, when police dragged Misran from a vehicle as he attempted to return home with his family.
Procedural Anomalies in the Appeal Process
Following the April 2026 acquittal, the legal drama shifted to the notification process for the prosecution’s cassation (appeal to the Supreme Court). Under Indonesian law, defendants must be formally notified of such appeals within a strict timeframe. Misran and his legal team grew suspicious when no notification arrived at his residence in Muara Komam.
Upon investigation at the local post office on May 18, 2026, Misran discovered the notification letters had been held there for weeks. More alarmingly, the documents bore a signature purportedly belonging to Misran, despite him never having seen or signed them. The post office cited a lack of fuel and transportation funds as the reason for the non-delivery, an excuse Misran’s legal team dismissed as "illogical." The discovery forced the defense to draft and submit a counter-memory of cassation within 24 hours to meet the May 19 deadline, narrowly avoiding a procedural default that could have jeopardized his freedom.
Fathul Huda Wiyashadi, a member of the defense team, noted that the prosecution’s appeal contained no new evidence. "We see this appeal as a face-saving measure for the police and the prosecution to cover up their initial failures in the investigation," Fathul stated. He emphasized that the trial testimony from the survivor, Anson, and other witnesses was inconsistent and failed to place Misran at the scene of the crime at the time of the attack.
The Legislative Catalyst: UU Minerba and Public Safety
The criminalization of Misran Toni cannot be separated from the broader legislative environment governing Indonesia’s mining sector. Activists point to the Law on Mineral and Coal Mining (UU Minerba), specifically Article 91, which permits the use of public infrastructure for mining activities under certain conditions. While the law mandates that mining companies should ideally build their own dedicated hauling roads, the lack of enforcement has allowed companies to utilize narrow, public-access provincial roads.
In East Kalimantan, this has created a permanent state of tension. Residents of Muara Kate and Batu Kajang have reported a surge in traffic fatalities, dust pollution, and road damage. "The government issues these laws from Jakarta without feeling the impact on the ground," said Warta Linus, a fellow activist who accompanied Misran to Jakarta. "They prioritize mining interests over the lives of citizens. We refuse to accept that our public roads should be turned into industrial corridors for private profit."
Jatam Kaltim is currently preparing a judicial review of the Minerba Law, arguing that the prioritization of hauling activities violates the constitutional right to a safe and healthy environment. Windy Pranata, Head of Advocacy at Jatam Kaltim, noted that the problem is not isolated to Paser Regency but is a systemic issue across East Kalimantan, including Kutai Timur and Samarinda.
National Advocacy and the Quest for Human Rights
Seeking justice beyond the local courts, Misran Toni and his supporters traveled to Jakarta in late June 2026 to bring their grievances to national institutions. The delegation met with the National Commission on Human Rights (Komnas HAM), the National Police Commission (Kompolnas), and the Ministry of Human Rights.

Legal analysts suggest that this case serves as a litmus test for the "marwah" (dignity and integrity) of the Indonesian judiciary. If the Supreme Court upholds the acquittal, it will provide a rare victory for grassroots activists facing the combined might of corporate interests and law enforcement. Conversely, a reversal would be seen as a chilling endorsement of the "scapegoating" tactics alleged by the defense.
"If the Supreme Court legitimizes the actions of the Paser Police and the prosecution, the essence of justice in this country is at stake," said Fathul Huda Wiyashadi. The case underscores a disturbing trend in Indonesia where the law is frequently used to silence opposition to extractive industries.
For Misran Toni, the acquittal was only a partial victory. While he is no longer behind bars, the shadow of the appeal looms over his life, and the true killers of Russel remain at large. The Muara Kate community continues its vigil, standing firm on the public roads that have become a battlefield for land rights, environmental safety, and the rule of law. The struggle of Misran Toni is more than a personal legal battle; it is a testament to the resilience of a community refusing to be crushed by the machinery of the coal industry.
